-      La conservación de losdatos durante el plazo determinado en el apartado de “Conservación de datos”,mientras que no sea revocado el consentimiento a través de los mediosfacilitados.

2.5.Tratamiento dedatos para el cumplimiento del servicio

En caso de que contrate el KIT DIGITAL con elresponsable del tratamiento. Este realizará los tratamientos oportunos para elcumplimiento del servicio y especialmente:

(i)            Cumplir con lasobligaciones legales del KIT DIGITAL

(ii)           Cumplir con lasobligaciones contractuales del servicio solicitado

(iii)         Cumplir con lasobligaciones legales fiscales

El tratamiento de datos utilizará cualquierdato indispensable para el cumplimiento de las anteriores obligaciones y entodo caso los siguientes datos:

-      Datosidentificativos del beneficiario (NIF, nombre…)

-      Datos económicos

-      Datos financieros (cuentasbancarias…)

-      Correos electrónicos

Este tratamiento implicará los siguientesactos:

-       Utilización de datos para el cumplimiento de lasobligaciones legales del KIT DIGITAL

-       Comunicación de los datos oportunos a Red.es entidadPública Empresarial adscrita al Ministerio para la Transformación Digitaly de la Función Pública, a través de la Secretaría de Estado deDigitalización e Inteligencia Artificial

-      Registro y ordenación dedatos del interesado

3.   LEGITIMACIÓN

3.1.No Clientes:

·      El tratamiento de datos de las comunicaciones depersonas interesadas en la prestación del servicio se hará en base alcumplimiento de obligaciones contractuales y precontractuales art. 6.1.b) RGPD

·      La utilización de datos y su comunicación a lasentidades oportunas de KIT DIGITAL se hará en base a las obligaciones legalesdel art. 6.1.c) RGPD.

3.2.Clientes:

·      Eltratamiento de datos de las comunicaciones de personas interesadas en laprestación del servicio se hará en base al cumplimiento de obligacionescontractuales y precontractuales art. 6.1.b) RGPD

·      Eltratamiento de datos para la prestación del servicio se realizará en base alcumplimiento de las obligaciones contractuales del art. 6.1.b) RGPD

·      Lautilización de datos y su comunicación a las entidades oportunas de KIT DIGITALse hará en base a las obligaciones legales del art. 6.1.c) RGPD.

3.3. Usuarios web

·     Eltratamiento de datos de cookies técnicas durante la navegación hace en base ala habilitación legal del art. 22.2 de la Ley de Servicios de la Sociedad de laInformación

·     Eltratamiento de datos del resto de cookies durante la navegación se hace en baseal consentimiento expreso del interesado (artículo 6.1.a) RGPD).  

4.    TRATAMIENTOS AUTOMATIZADOS

DesdeQSIMOV QUANTUM COMPUTING S.L. se informa de que se utiliza un tratamientoautomatizado de datos en el formulario de contacto. Dicho tratamientoautomatizado consiste en registrar y organizar la información introducida en elformulario de contacto para poder efectuar una respuesta.  

Encualquier caso, dicho tratamiento no supone ninguna consecuencia legal nijurídica relevante. Tan solo permitirá al responsable responder al interesado.

5.   INFORMACIÓN PARA LOS USUARIOS. IP

Los servidoresde QSIMOV podrán detectar de manera automáticala dirección IP y el nombre de dominio utilizados por el usuario. Una direcciónIP es un número asignado automáticamente a un ordenador cuando ésta se conectaa Internet. Toda esta información es registrada en un fichero de actividad delservidor que permite el posterior procesamiento de los datos con el fin deobtener estadísticas que permitan conocer el número de visitas realizadas a losservicios web, el orden de visitas, el punto de acceso, etc.

Si registramos sus datos de IP(Internet Protocol) asignado al abonado titular de la línea telefónica en elmomento de la conexión con el presente Web, para la finalidad de seguridad(protección anti ataques) y colaboración con la Justicia. Los datos seránconservados por el prestador de servicios el tiempo marcado por la legislaciónvigente.

6.   DERECHOS DIGITALES SOBRE TUS DATOS

El prestador garantiza en todo casoal usuario el ejercicio de los derechos de acceso, rectificación, cancelación,información y oposición, en los términos dispuestos en la legislación vigente.

El tratamiento de los datospersonales y el envío de comunicaciones por medios electrónicos, en su caso,están ajustados a la normativa establecida en la Ley Orgánica 3/2018, de 5 dediciembre de 2018, de Protección de Datos de Carácter Personal y Garantía delos Derechos Digitales y en la Ley 34/2002, de 11 de julio, de Servicios de laSociedad de la Información y de Comercio Electrónico.

6.1.Información.

El usuario tiene derecho a solicitardel responsable que se le informe de todos los datos de quien trata sus datos,así como el período y finalidad para los que se recogen. También, el periodo deconservación, o los criterios utilizados para determinar dicho plazo.

6.2.Acceso.

El usuario tiene derecho a solicitaral responsable poder acceder a sus datos aportados en virtud del registrosiempre que lo requiera.

6.3.Modificación y Rectificación

En cualquier momento, el usuariopodrá acceder a sus datos para modificarlos, y que sean siempre veraces yactuales. Asimismo, podrá, y debe, rectificar cualquier dato que seaincompleto, inexacto, desactualizado.

6.4.Cancelación

El usuario tiene derecho a solicitardel responsable del tratamiento de datos que sus datos, cuando no sean exactos,veraces, o completos, puedan ser cancelados, y por tanto suprimidos decualquier fichero o archivo donde los mismos sean almacenados.

También podrá solicitar sucancelación inmediata cuando se dé de baja del servicio ofrecido por la web www.qsimov.com/kit-digital en caso de nohaberse realizado la misma inmediatamente.

6.5.Supresión (derecho al olvido)

El usuario, por solicitar la baja delos servicios, podrá solicitar del responsable del tratamiento que eliminetodos sus datos personales de cualquier archivo o dispositivo donde seconserven, para que sean totalmente suprimidos, sin que pueda guardarse copiade ellos, o seguir comunicándolos a terceros.

La BAJA del usuario en la web o encualquier base de datos, supone que el fin para el cual los datos finaliza, porlo que dichos datos dejan de ser útiles.

6.6.Limitaciones al tratamiento.

El usuario tendrá derecho a obtenerdel responsable del tratamiento la limitación del tratamiento de los datoscuando se cumpla alguna de las condiciones siguientes:

1.   el usuario impugne la exactitud de los datospersonales, durante un plazo que permita al responsable verificar la exactitudde los mismos;

2.   el tratamiento sea ilícito y el usuario se oponga ala supresión de los datos personales y solicite en su lugar la limitación de suuso;

3.   el responsable ya no necesite los datos personalespara los fines del tratamiento, pero el usuario los necesite para laformulación, el ejercicio o la defensa de reclamaciones;

4.   el usuario se haya opuesto al tratamiento, mientrasse verifica si los motivos legítimos del responsable prevalecen sobre los delusuario.

6.7.Derecho a la portabilidad.

El usuario tendrá derecho a recibirlos datos personales que le incumban, que haya facilitado a un responsable deltratamiento, en un formato estructurado, de uso común y lectura mecánica, y atransmitirlos a otro responsable del tratamiento sin que lo impida elresponsable al que se los hubiera facilitado, cuando:
